Mr E suffered severe injuries when he lost control of his car after hitting a patch of standing water that had accumulated on the road due to a blocked drainage ditch.

The Council vigorously denied liability – initially blaming the local landowner and, later, when it was established that the ditch was part of the highway, arguing that they had properly maintained the ditch. The claim settled for an amount in excess of £350,000 after the Council failed to produce any evidence to show the drainage ditch had been maintained.

Mr B, from London, suffered a whiplash injury in a road accident while driving home after work. Mr B rejected the offer and, with Gorman Hamilton’s assistance, was later awarded over £3900.

Mr R suffered a severe fracture to his ankle in an accident at work after he slipped and fell while climbing down from a machine that he was operating. The steps on the machine were damp and the soles of Mr R’s workboots had mud and oil on them, making them slippery.

Mrs A was returning home from a shopping trip and was driving slowly along a residential street passing a line of parked cars on her left. As she drove past the parked cars a vehicle pulled out from a driveway on her left and collided with the side of her car.

The other driver immediately blamed Mrs A for the accident saying that she had caused the accident by swerving to the left and driving too fast. The other driver’s insurance company refused to pay Mrs A’s claim and, furthermore, obtained a witness statement from a neighbour supporting the allegations.

After carefully considering all the evidence, including the accident damage and the accident location, Gorman Hamilton advised Mrs A to pursue her claim to Court. Not long after starting Court proceedings, Mrs A accepted an offer of £5870 in full and final settlement of her claim.
